Administrative offence proceedings
Administrative offence proceedings involve less serious infringements of the law, i.e. administrative offences, which are usually sanctioned by imposing a (non-criminal) fine.
Administrative offences are not criminal offences, which may result in the imposition of a monetary fine or imprisonment.
The supplementary penal provisions outside the Criminal Code (such as environmental criminal law, food criminal law, criminal employment law and capital markets criminal law) govern a number of administrative offences along with criminal offences.
What’s more, in almost every white-collar crime context, breaches of the law committed by staff may be attributed to their employer company. As a consequence, a corporate fine may be imposed on the company.
